How B2B marketing is bought in Spain

Two laws apply simultaneously and LSSI wins: GDPR/LOPDGDD governs whether you may process the data, but Ley 34/2002 (LSSI-CE) Article 21 governs whether you may send the commercial email, and you must satisfy both.

GDPR relief does not rescue you — the AEPD states the arrival of the GDPR is irrelevant to this question, so even a perfectly documented legitimate-interest balancing test buys you nothing at the point of send.

There is no B2B carve-out: LSSI Art. 21 restricts commercial communications to destinatarios without distinguishing natural from legal persons, so a UK marketer relying on PECR's corporate-subscriber exemption is non-compliant on day one.

Enforcement is routine rather than headline-grabbing — publicly reported cases include €5,000 for sending advertising without recipient consent (EXP202312711) — which is what makes it a real operational risk.

Madrid is corporate, enterprise-IT, telco and public-affairs and is where the go-to-market and RevOps consultancies cluster; Barcelona is startup, product and e-commerce with the strongest MarTech and inbound heritage; but the genuine industrial B2B capability is in neither — it is in Valencia and the northern industrial belt.

No Spanish agency in this set publishes a rate card, company registration numbers are much harder to source than in Italy (only Cyberclick publishes a CIF), and BBN International lists no Spanish partner agency.

The trade body is ACT — Asociación de Agencias de Creatividad Transformadora (founded 1977 as AEACP, refounded as ACT 2019-2021), which is the closest thing to an independent register of who is real.

An English page is not an English agency

Spain has a large, capable agency sector that is overwhelmingly domestic-facing and Spanish-language — only Gotoclient and Reux Digital are genuinely English-first, with Cyberclick and The Marketing Hub as full bilinguals. Watch for fake bilingualism: GO2JUMP's /en URL exists but serves the Spanish page, and several agencies doing real international work (Sakudarte, The Revenue) publish no English at all.

This matters more than any ranking. An agency whose canonical site sits in the local language with an /en/ stub bolted on will usually deliver in that language too — fine if you have a local team, expensive if you do not.

The UK carves business recipients out of its direct-marketing rules. Most of Europe does not, and assuming otherwise is the most expensive mistake a foreign buyer makes here.

The regulator is Agencia Española de Protección de Datos.

Ask any agency to explain its lawful basis before you sign. If they cannot, that is your answer.
